Government Fee Changes for the CR1 and IR1 Marriage Visa

As the title of this video suggests, we are discussing proposed fee changes associated with specifically petitions for Immigrant Spousal Visas. That is either the CR-1 or the IR-1 category depending on the amount of time that one has been married to their foreign spouse at the time that that spouse enters the United States. 

In the past, the filing fee for the form I-130 which is what is necessary in order to petition for a CR-1 or an IR-1 Visa, in the past, that application fee was US$535; the currently proposed fee is US$555. I think it is fairly safe to presume we are going to go ahead and see that proposal come of fruit and so I think it is fairly safe to assume that we are going to go ahead and see a US$555 filing fee at some point in the relatively near future. 

Now that being stated, does this overall impact any other part of the process of the fees associated therewith? Not particularly. The Department of State fees are dictated to by that Department so at this time basically what we are dealing with is a fee increase at the Department of Homeland Security exclusively. 

Another thing that should be noted is the I-130 also may act as the underlying petition which may operate in order to act as a sort of a platform if you will to file for a supplemental K-3 visa application. In the past, we didn't see a lot of K-3s. Since the Trump Administration has come in I think it is likely we are going to see more moving forward. The K-3 is basically used as a term on the internet basically to describe all marriage visas but that is actually a misnomer. The underlying spouse visas are the CR-1 or the IR-1. The K-3 is simply an expedited spouse visa for spouses of American citizens.

So the thing to take away from this video is I think in the fairly near future we are going to see a fee increase for the CR-1 and IR-1 Visa and by extension the K-3 Visa as well.
