Withdrawal of a K-3, CR-1, or IR-1 Visa Petition?
Transcript of the above video:
As the title of this video suggests, we are asking the question, well we are talking about withdrawal of K-3, CR-1 or IR-1 visa petitions. Now, we could also say application, but understand there is an actual difference between a petition for a US Visa - that's the underlying I-130 petition that is processed by the Department of Homeland Security - as opposed to the application for a visa that is processed through not only the National Visa Center in the United States but as well as the various Embassies and Consulates around the world.
So depending on where you are in the process of seeking one of these Marriage Visas will oftentimes dictate the manner in which the case is abandoned; how you withdraw the case i.e. do you only need to notify Department of Homeland Security or do you need to notify the Embassy and the National Visa Center of the intention to withdraw? Who do you need to tell? Well it depends on where you're at in the process. Also understand it's not that onerous a process of withdrawing a case. That said, you should do it after serious deliberation, because if you do withdraw it, then the case is withdrawn, it's gone, and you have to start all over; so understand that. That being said, and the thing to understand in this video is withdrawing from a Spousal Visa case is substantively different, qualitatively different if you will than withdrawing from a Fiancé Visa case because Fiancé Visa case withdrawal has implications under the International Marriage Brokers Regulation Act which I have discuss in another video I've made contemporaneously with this one.
That said, the point of this video and the thing to understand is sometimes withdrawal is necessary for whatever reasons. Intentions change, perhaps the marriage itself is no longer viable and is ending so you need to withdraw the petition, or the application. Again, it depends on where you are in the process, and where you are in the process will dictate the manner in which you withdraw an application for a K-3, CR-1, or IR-1 Visa to the United States.
