K1 Visa Thailand: Proving a Bona Fide Relationship

Transcript of the above video:

As the title of this video suggests, we are discussing K-1 visas from Thailand and we are specifically discussing the evidence associated with bona fide relationships.

In recent months I have seen more Requests for Evidence than I have seen generally speaking as a ratio of cases within my practice, I have seen more Requests for Evidence related to the K-1 visa when compared to times past.

Depending on the given case, it may vary why the RFE was issued but I do seem to think that there is something of a trend with respect to, they want to see increasing evidence that the relationship is genuine.  I have also seen request for further evidence from the Embassies here in Southeast Asia, so the Embassy in this case in Bangkok, Thailand wanting to see more evidence of the relationship between the parties.

So it appears bona fides with respect to fiancée visas are an important issue or I should say that they have always been an important issue but they are I believe viewed as increasingly important under the current Administration.

So those who are looking to get a K-1 Fiancée Visa, it should be understood that they need to prove up that they have met in person pursuant to the legal requirements of the K-1 Fiancée Visa and they need to show evidence of those meetings. They need to show evidence for example if an engagement party has taken place, evidence that meetings of the couple's families, or one party to the couple meeting with the other party's family and vice versa, or the families meeting etc. etc.; this kind of evidence is very good. Also evidence of ongoing contact of an ongoing relationship is also very important with respect to a K-1 Fiancée Visa.

It is probably a good idea for those who think that they may have some issues with regard to this specific requirement, it is probably a good idea to contact a competent legal professional in order to ascertain the exact nature of one's situation and go ahead and try to present the most strongly compiled case file in order to hopefully forestall Requests for Evidence and go ahead and see an approval processed through in the smoothest manner possible.
