IR-1 Visas from Thailand: Changes to the I-864 Form

As the title of this video suggests, we are discussing the Immediate Relative Visa. It is an Immigrant Visa, this is the IR-1. Generally speaking, we see this with respect to Thai spouses of American citizens although it could be for Permanent Residents; it depends on the circumstances.

Long story short, the folks that get an IR-1 Visa, get an unconditional Lawful Permanent Residence at the time of entry. They are an immigrant basically sort of a landed immigrant. They have lawful permanent residence from their moment of entry. One of the major obstacles in my opinion that the prior Administration put in the path of a lot of intending immigrants was via the Public Charge Rule. They greatly jacked up the requirements if you will, the threshold one needed to meet with respect to the financial requirements to bring an immigrant spouse to the United States. The form associated with that is the I-864 and there were a lot of changes to the I-864. It now appears that these changes are all being rescinded. The current Administration is sort of walking all that policy change back and concomitant with that, it now looks like they are going to be phasing in a new if you will, I think it is really kind of more just a reversion to an older iteration of the I-864 form.

So over the next 6 weeks, apparently this is going to be phased in, the end result being that the form that was operating under the old Administration is no longer going to be used. We will keep you updated on this channel as the situation progresses but long story short, you get to use a more truncated version of the I-864 moving forward.
