Why the Disparity Between Thai Non-immigrant Visa and DTV Requirements?

As the title of this video suggests, we are discussing the disparity between basically the requirements and parameters associated with Non-immigrant Visas versus this new Destination Thailand Visa. I have noticed this because frankly, I actually didn't notice it directly. For those who are unaware, as I made clear in other videos, I am a naturalized Thai, so I don't have to deal with certain aspects of the immigration system at the ground level to the extent I once did.
Now that said, our firm deals with a lot of Thai and US Immigration matters so we are dealing with the sort of picayune details of Thai Immigration on quite a regular basis. A couple of clients have brought some things up to me recently with regard to the kind of policy inconsistencies associated with the DTV versus standard Non-Immigrant Visas, especially Business Visas. I've had a number of small business owner clients over the past few weeks bring up to me, in correspondence as well as in person that, "hey, we're being heavily scrutinized." Anybody that has ever done a Business Visa renewal here in Thailand especially for those who own their own small business will know that the scrutiny associated with standard Business Visa renewals is high to begin with - the documentation requirement is high to begin with - and then at the same time, we are now seeing heightened scrutiny probably as an upshot of the Government's initiatives in trying to track down and ascertain whether or not folks are using nominee structures for illicit purposes here in Thailand.
We have talked about that a lot in other videos, but the point of this video is, again to sort of point this out. I brought this up going back a couple of years ago now when we were dealing with the Government or the incoming Government of Ms. Paetongtarn Shinawatra. Prior to that it was Mr. Srettha Thavisin in the aftermath of the elections and then the formation of the Government in 2023 which by the way the Pheu Thai Party did not have an electoral mandate to bring in a lot of these Immigration initiatives; nobody particularly was looking for this stuff. But again, I talked about it at the time, the Destination Thailand Visa was so opaque with regard to its requirements and its parameters. And then at the same time, I keep questioning like and others have now - other foreign nationals have brought this up - that what exactly is the Immigration apparatus doing in encouraging folks who aren't coming here to directly, essentially add anything or to basically how shall we put it, they are not coming in to essentially add into the economy, but instead they are just sort of here, and they are interacting with outside economies, but they are remaining physically present in Thailand, but they can't bank here, so they are not bringing in money. And then meanwhile, again they have to do a Border Run maybe every six months. They can do one renewal, it is our understanding it's one renewal can be done in-country, but again meanwhile, we are seeing heightened scrutiny on folks that are paying taxes that are kicking something in to Thailand and are adding value to the overall economy. There seems to be something wildly incongruent about these policies. And looking back on that government - what eventually I came to call the rump coalition Government going into this last summer in 2025 - I'm starting to really wonder and in light of the fact that that Government was so heavily influenced, unduly, by foreign I think banking as well as other influence in terms of the World Economic Forum etc., I'm starting to wonder if it was that Government's intention to bring in a bunch of people to effectively destabilize Thailand. We have seen this in the context of other countries and having seen the correspondence that I have seen from folks that are sitting here saying, "hey, I'm here on a standard Marriage Visa. I am getting hassled constantly, I am getting spot checked but meanwhile I am maintaining my balance and I'm taking care of my family here." - Some of these folks have a Work Permit, some may not - same thing with Business Visa holders. They are saying, “Look, I have to provide a phone book worth of documentation to renew my Business Visa. And meanwhile, somebody that can just produce some documentation that says that they have $15,000 in a bank account can get a 5-year visa and just be here? How does that make a lot of sense?”
Now as we have discussed in other videos, Destination Thailand Visa is not work authorized; they also cannot get Bank Accounts. Those that have a bank account, we have seen that banks have closed their bank accounts because they have said you can't have that on a DTV Visa. The point I'm trying to make with this video, I know I don't make myself particularly popular amongst the so-called nomads set, but I really don't care at the end of the day. At the end of the day, I care about my adopted country, and I care about good policy that is going to do right by folks all around. Frankly, I think if things go in a negative directions stemming from certain aspects of the DTV, we could see a situation where the foreigners find themselves at odds with the Thais in such a way that they never have in the past because of these bad policy decisions. So if anything, I am worried about maintaining a harmonious balance between the Expat community and the Thai locals here in an effort to keep everything on an even keel if you will. And again, based on the correspondence that I have read, and things that clients have brought up, it does raise a pretty valid point. Again, why the heightened scrutiny on people that are paying taxes, that are working legally in Thailand, that are doing things correctly and maintaining a business that adds value to the overall Thai economy and then meanwhile, just almost kind of not really even caring about a bunch of people that come in and don't do all of those things.
They are valid points. It will be interesting to see how all of this plays out as we go through the ongoing term of this present Government. We will certainly be keeping folks updated on this channel as the situation evolves.
