Thai Immigration Laws on TM30 and TM47?
Transcript of the above video:
As the title of this video suggests, we are discussing TM30 and TM47 in Thailand. For those who are unaware, this pertains to address reporting for those who hold Non-Immigrant Visas in the Kingdom; that's the vast majority of people who are going to be staying here long-term. As noted in other videos, this does not pertain to people who have Permanent Residence in Thailand which does not mean somebody who has a so-called "Residence Visa". Permanent Residence is exactly what it sounds like, it is Lawful Permanent Residence in the Kingdom. So again, Non-Immigrant Visa holders TM30 and TM47 pertains to you.
I thought of making this video after reading a recent article from the Pattaya Mail, that is pattayamail.com, the article is titled: Expanded Homestay seen as a booster for Thai tourist numbers. I urge those who are watching this video, go read that article. The thrust of it is very different than what we are discussing here but long story short, it appears the presumptive new government is talking about the possibility of creating sort of a Homestay Visa to sort of maybe spread the wealth a little bit in terms of Tourism money coming in to the Kingdom insofar as go to a Homestay regime would allow foreigners to stay in people's homes sort of on a longer-term basis, kind of like a cultural exchange it seems like. Not a bad idea I don't think at least in theory. Again the devil is always in the details and putting things into practice is oftentimes more difficult than it might at first seem.
That said, the point of this video pertains to TM30 and TM47, therefore again quoting directly from the article: Expanded Homestay seen as a booster for Thai tourist numbers, pattayamail.com. Quoting directly: "Mr. Limjaroenrat, (and that is the presumptive possible new PM, the head of the Move Forward Party) quoting further: “has also suggested Immigration rule changes to allow visitors to stay longer although he gave no details. More pressingly, he might order an investigation into the rules that tourists and expats find so irksome - registration of address-on-arrival (TM30) and re-registration every 90 days (TM47)."
So yeah as noted in other videos, it is required that foreign nationals in Thailand who are in non-immigrant status and remain in Thailand for 90 days or more, they do have to register their address and have to continue renewing that registration on an ongoing basis every 90 days. As we have discussed in other videos, this may be possible to do it online although many find that can be a bit of a cumbersome process and therefore end up opting to do it in person. We here in our office oftentimes assist with TM30 filings and TM47 filings on behalf of our clients but again this is something that many foreign nationals, it's not a favorite topic amongst many foreign nationals. I can understand why, I had to deal with it when I was a foreigner here in Thailand but again it doesn't appear that the Immigration Act of 1979 is going to be amended anytime soon. Again we would need Parliament to reopen and for new legislation to be promulgated in order to see an end or any major changes to TM30 and TM47. That does not appear likely at least in the immediately foreseeable future but we will certainly keep you updated on this channel as the situation evolves.
