Foreigners Who Enter Thailand Illegally Cannot Do Business?

As the title of this video suggests, we are discussing foreigners who enter Thailand illegally and trying to do business. I thought of making this video after reading a recent article, not an article, it is actually the Act, specifically the Foreign Business Act, section 6, I got this from dbd.go.th, so this is a Thai Government website, this is a copy of the Act translated into English. 

Now understand, I am not a Thai Attorney, I have never claimed to be a Thai Attorney, I am an American Attorney, I have Thai nationality, I am Managing Director of this firm. We have Thai Attorneys on hand in this firm; I have gone over what I was going to do in this video with them so we are all on the same page; this video is for educational purposes only; it is not a definitive legal opinion.

But I did find this interesting: Section 6: The following foreigners may not operate any business within the Kingdom:

(1) A foreigner who has been deported or whose deportation is pending;

(2) A foreigner entering and staying in the Kingdom without permission under the laws on Immigration or other laws. 

So it's interesting, I've had people over the years ask me when we are dealing with like Thai Company setups and we need to see a copy of their Visa or their most recent entry stamp whatever, their Immigration status documentation, they say "whoa why does the DBD need to see that? Why does the Commerce Ministry need to see that?" Well, this is why. The Foreign Business Act specifically says if you enter illegally you can't do business in Thailand therefore you can't be on a Company so that's why they want to see your Immigration documentation basically, at the end of the day. 

So again, something that some foreigners may find frustrating, it is just enshrined under the relevant Thai Law.
