Dual Nationality Issues for Children Born in Thailand?

As the title of this video suggests, we are discussing, well issues associated with dual nationality in Thailand. I thought of making this video after reading recent article in the Pattaya Mail, pattayamail.com, the article is titled: Thai compulsory insurance for all foreigners threatens chaos. I urge those who are watching this video it's worth a read. That article has got a lot of good information in it. Quoting directly: "Other implementation hazards are that Airlines would have to decide who is a foreigner and who is not." What they are talking about here is the possibility of mandatory Insurance coming online for foreign nationals coming into Thailand. Quoting further: "Presumably a dual national, many are children, booking a ticket would be charged if showing a foreign passport yet escape with a Thai one. The details of handling passengers arriving by sea and are still unknown even as cruise ships and private yachts become a common sight in waters of Pattaya and Phuket. There is still no confirmation on any age limits for the compulsory insurance which could make it impossible for the advanced elderly to enter without an independent policy which they likely could not obtain in any case." Yeah, with respect to insurance for elderly folks, I think we are probably going to see further clarification on that sometime by the end of the year going into the New Year we will probably start to see some inclination on where that is going. Now for those who are concerned about this, I would not fret. This is not a reason to panic, don't worry too much. I do think ultimately some kind of reasonable scheme is going to be brought out. 

The reason for the video though, just to quote this again: "Presumably a dual national, many are children, booking a ticket will be charged if showing a foreign passport yet escape with a Thai one." Yeah most children, children generally speaking in dual nationality it can be a complex and nuanced thing. So it very much depends on the two nations you are talking about. By and large, children who are under the age of consent, well not the age of consent, the age of majority in a given jurisdiction, so for example 18 in the United States generally speaking, 20 in Thailand, don't necessarily have to make determinations as to whether or not they are a national of two countries, they are a national of only one country and want to give up their other nationality; they don't have to make those decisions until essentially they come of age. So generally speaking, where you see children born in Thailand, you often times will see them operate with two passports simultaneously. There is none of this notion of "well I am leaving on this and coming" no generally speaking, I have dealt with children who have dual nationality, it is noted on their flight itinerary and things that they are Thai and whatever else; they are Thai and Canadian or whatever it may be, Thai- American whatever it may be. That child still hasn't had to choose their nationality if they ever need to depending on the circumstances of their situation, they have never had to choose if they are exclusively one nationality or the other. So really when reading that excerpt I thought it was worth noting that okay yeah if you are only using one passport but you don't have to do that, in fact you really should have the child travel out if it's a Thai on their Thai passport and enter whatever country they may be a national of on their other passport and just use both of those passports exclusively for the entrance to the country to which they pertain. Again in Thailand this would negate any need I would see with respect to this insurance requirement because they would be noted as a Thai national notwithstanding the fact they may have another passport in another country.
