Dealing with Overstay and Blacklist Issues in Thailand

Transcript of the above video:

As the title of this video suggests, we are discussing overstay and Blacklist in Thailand. This is just kind of a general video. If you are someone who thinks they may go into overstay or they may be adjudicated to be in overstay at the time that they leave or you have concerns about the possibility of departing the Kingdom and being placed on the Blacklist but you remain in Thailand, it is a very, very, very good idea to contact a legal professional who deals with these things in order to gain some insight before leaving Thailand.

It may be a situation where the situation is not rectifiable, you can't deal with anything and you just have to leave and deal with the consequences but there are some circumstances where it may be possible, I stress may be possible for somebody, given the set of facts on their case to possibly ameliorate the downside, for example mitigate the amount of Blacklist if any, that may occur as a result of an overstay in Thailand or to deal with one's overstay. There are circumstances, we have seen them here since this whole pandemic and the Emergency Decree was promulgated back in March 2020 where Thai Immigration will exercise some favorable discretion for folks that just got caught out; they just basically went into overstay, it was not really any fall to their own, and they had a situation that needed to be rectified. It can happen. It is not a foregone conclusion but for those that think they may have a problem if they depart the Kingdom with respect to a possible finding of overstay or a possible blacklisting or for anything for that matter, again it may be a good idea to contact a legal professional before leaving the country.
