Business Visa Issues During Thai Company Setup

As the title of this video suggests, we are discussing Business Visas in the context of Thai Company setup. This is kind of one of these situations, you see a lot of this when dealing with Immigration in Thailand, there is a lot of "cart before the horse" if you will, "chicken or the egg" also kind of catch-22 circumstances that can arise. What are we talking about here?

Well there are a number of requirements associated with Thai Business Visa notably a Company to sponsor. So, if you are looking to come to Thailand to become self-employed, to set up a Thai Company, again there is a chicken or the egg phenomenon going on here. Okay, I need to have the Company set up in order to get the Business Visa. Well if you are abroad for example, in order to get a Business Visa you need a work pre-authorization document. Well you have to have a Company to have that so how do you deal with that? Well there are a number of different ways. We often tailor different solutions to different clients. In some circumstances it can be done remotely; in some circumstances an initial trip here; depending on the circumstances it may be possible to regularize status in country but bear in mind if you are using a Thai Company to sponsor essentially yourself if you are wanting to be self-employed, for a Business Visa, there are a number of tumblers essentially that have to fall in order to unlock that lock where it is going to be possible for a Business Visa to be issued. In fact there are a number of steps that have to be taken to meet the qualifications for a Company to even sponsor a Business Visa. 

So the thing to take away from this video is first of all understand that there is a lot of nuance, it can be very circular. I have talked to a number of clients about this and that is the most concerning thing to many people is it just feels so circular. I am very used to it so I seem kind of dismissive sometimes where, "yeah, it just is what it is. You've got to get this, you got to do that", and in my mind it just kind of makes sense but for folks who are dealing with this for the first time it can be very daunting. For that reason, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
