Bank Balances and Thai Marriage Visas?
Transcript of the above video:
As the title of this video suggests, we are discussing Bank Balances associated with Thai Marriage Visas. For those who are unaware, Thai Marriage Visas there is an O category, I call it sort of the miscellaneous or other category, the kind of catch-all category if you will in the Immigration Act of 1979 or I should say pursuant to the Ministerial Regulations completed or I should say promulgated thereby, the Thai O Visa can be issued for marriage purposes, you can just get an O Vasa based on being married to a Thai national if you are a foreigner. However there are financial requirements associated with that.
For those who are unaware, there is one requirement that needs to show 40,000 Baht in income coming into a Thai Bank Account or 400,000 Baht maintained as a Bank Balance maintained ongoing in order to maintain or in order to extend a Thai O Marriage Visa. So the thing to take away from this video is to understand, in the past there was some heightened scrutiny associated with Bank Balances associated with O Visa renewal, O Visa Extension. There actually was a time, I remember there was one year and this is going back about 8 years ago roughly something like that, there was a time when it was very difficult to, well there was way heightened scrutiny because there were a number of sham marriages that had occurred. For this reason, there was all kinds of heavy inspection going on of marital houses and things for people that had applied for an O Marriage Visa and also there was heavy scrutiny associated with Bank Balance. So again in the past they kind of said "hey we want to see that you have 3 months back from the time that you apply for your renewal" and oftentimes they would sometimes say "we want to even see that that balance is maintained past the renewal on the next go around, the next year".
Now that heavy amount of scrutiny we haven't seen in some time probably due to the fact the Emergency Decree was promulgated in 2020 in response to the pandemic. That was repealed back in the third, fourth quarter of 2022 but that gave Immigration a great deal of discretion associated with extension of Thai O Marriage Visas, discretion that they no longer have and we are now back to sort of status quo ante. So bear in mind, there is a possibility for heightened scrutiny again of Bank Balances associated with Thai O Marriage Visas.
