Thai Lease Registration at the Land Department

As the title of this video suggests, we are discussing, well we are discussing Thai Lease registration. For those who are unaware, it is possible for foreign nationals to have a lease over real estate. Notwithstanding the restrictions on foreign nationals owning actual land in Thailand, it is possible for foreign nationals to register a lease, a long-term lease at that - 30 years per instrument so you can have a single instrument lease which has a 30-year duration. That is pretty significant; we have many clients that opt to go with the lease route but there is a process by which that lease has to be registered on to the title deed, the Chanote, it is called a Chanote in Thai that conveys freehold title to allow for the lease. 

The thing to take away from this video and the thing to understand it that it is not just a matter of filling out a document, filling out a contract if you will, that just says “I am leasing this for 30 years”. No, there are formalities and it has to be registered with the Land Office here in Thailand in order for it to be considered valid pursuant to the Civil and Commercial Code which governs such matters here in Thailand.

So understand there are formalities, there are process associated with getting that lease registered, there are even some taxes that are going to be owed at the time that the registration occurs. You have got to get all these ducks in a row before you can perfect such an instrument here in the Kingdom of Thailand.
