Renting a Condo in Thailand?

As the title of this video suggests, we are discussing renting a condo in Thailand and to be clear, I want to clarify this from the beginning. This video isn't so much talking about somebody who comes to Thailand and just rents a condo. A foreign national comes to Thailand they rent a condo from another foreigner, a Thai, whatever but they rent a condo, no that's not what I am talking about. We are talking about if you own a condo in Thailand and you are looking to rent it out. 

There actually are some issues that can arise with this. There have been situations where this was determined to be a service and therefore a Work Permit is needed in order to rent out one's condo. For that reason I have seen various folks possibly take up the service of a real estate agent to essentially assist in that process so that they don't get into any kind of Work Permit problems with respect to the underlying rental. Again, it's going to be very factually dependent; it's going to depend on the discretion of any relevant for example Immigration or Labour Department Officer but yeah that can be an issue for a foreigner renting out a condo here in Thailand. 

Again, not talking about a foreign national who just comes here and wants to rent it from somebody else. That is acceptable, there's not any problem. Obviously lots and lots of people do that every year and that is not what we are saying here. But if you own a condo in Thailand and you are actively renting it out, as we have discussed in other videos, Air B&B is kind of a No-No here but if you are just renting it out even on a long-term basis, it could be deemed to be a service you are providing and you may have some issues with respect to Work Permit. Again, that being said it is going to depend on the underlying facts of the given case. If you are kind of worried about this, it may not be a terrible idea to contact a legal professional, gain some insight and guidance into how best to proceed.
