Thai Condo Ownership: Working from Home?

As the title of this video suggests we are talking about Thai Condos, specifically the question has arisen regarding working from home in a Thai Condo here in Thailand. The reason for this video is we are kind of coming to the end or at least we are basking in the light at the end of the tunnel of this whole COVID thing for lack of a better term. There have been exigent circumstances in the last couple years where folks had to work from home and the question posed is "Well can I continue to work from home?" I have had some foreigners ask me this and the answer to that is well it kind of depends. It very much depends on circumstances.

We have discussed, people that own their own business here in Thailand and for example are Managing Director of their own Company here in Thailand, have a Work Permit as such, yeah it is hard to quantify and qualify when they are working and when they are not. So when they are at home answering emails, if they have got a valid Work Permit, nobody is going to cause them any issues. Meanwhile, one big issue associated with Thai Condo ownership that people oftentimes make an assumption about this, really a misplaced assumption is, “well I can just re-domicile my Company into my Condo”. Yeah that is easier said than done. In most cases, it is going to be pretty much impossible. There are requirements associated with Tax Certification for Companies that employ foreign nationals so re-domiciling a Corporation inside of a Thai Condo can prove rather nettlesome to say the least. The other issue associated with that is Thai Condos are specifically zoned residential. Now there may be exceptions to this where you will see companies in kind of Condo/Condotel kind of structures but this is more rare than it is frequent in my experience and something that you will often see associated with this is well one, they will usually be Companies that are quite old that pre-existed a lot of the current rules which essentially require that tax certified companies essentially be on commercial real estate. 

So the thing to take away from this video is yeah in the sense of “can you continue to work remote sort of as you did during COVID?” Probably, again it is circumstantially dependent but as far as trying to re-domicile one's Company into one's Condo, that can prove difficult to the point of likely impossible.
