A question I get a lot from people, especially those are looking to kind of set up shop here in Thailand; get on a Work Permit; get on a Visa and get a Company going and then start doing their time so to speak, going for maybe Permanent Residence, maybe Thai Citizenship at the end of the long tunnel. But a big question is "Well I am looking to buy a condo. Can I just incorporate my Company in my condo?"

The short answer is that it is pretty unlikely, it is unlikely you will be able to do that for a number different reasons. One of the big ones is tax certification. Many condos are considered residential areas and for that reason it is oftentimes going to be difficult if not impossible to get certain types of tax certification especially for foreigners which will likely be necessary in order to get a Work Permit, so this has been our experience. I am not saying, yeah there are a million ways to skin a cat. Things are done very differently from province to province in Thailand. Overall, the policy theme seems to be that "look we don't really want to mix commercial with residential" although there are circumstances where that may happen, generally not in a condo situation. The other issue to remember with respect to this is Juristic Persons oftentimes have an issue with this because it may lead to a situation where there is a higher level of possible property tax on the underlying property if there is commercial activity going on. So for a lot of different reasons, it may not necessarily be the easiest thing if it is even possible to incorporate a Company on a Condo here in the Kingdom of Thailand.
