Can I Do a "Condo Swap" in Thailand?

As the title of this video suggests, we are discussing "condo swaps". We are discussing condos because condos are one of the most frequently owned types of property for a foreigner here in Thailand because foreign nationals can own Thai condos in 100% freehold. They can have freehold title, Chanote title, 100% ownership notwithstanding the fact that they are a foreigner. This is a real benefit compared to other types of Thai property for example land, real estate, that type of thing.

The question posed here is: "Can we swap condos?" What are we talking about? For example in the United States if one real estate owner wants to go ahead and swap property with another real estate owner, they don't want to sell to each other because that may create a different type of taxable event and believe me the tax codes in both the States as well as the Federal Government have provisions dealing with swaps, it is out there. Long story short, yes in the US for example, it may be possible to swap. 

In Thailand don't presume that and the reason for this is believe me when I say this, they get the bulk of their tax money from property from transfer fees. These are assessed at the time of a transfer of real estate at the Land Office here in Thailand, the Land Department. A swap could essentially sort of circumvent that which oftentimes is the reason people try to do it or at least mitigate certain tax liability. Here in Thailand that is not really something they are going to be keen on doing so presuming it is going to be possible, I can see some circumstances where effectively it might be able to be done but I would say in the vast majority of cases, No, you are not going to be able to do something akin to a "swap of condos" among foreigners here in the Kingdom of Thailand.
