Thai Condo Transfer Issues

As the title of this video suggests we are discussing issues with Thai condo transfers. What specifically are we talking about here? Well we are talking about it in the context of foreign nationals so let's be clear on that from the get-go. We are not talking about condo transfers from Thai to Thai.

That said, pursuant to the Thai Condominium Act, there are certain formalities which must be undertaken in order to register the ownership of a Thai condo in freehold to a foreign national and when transferring out of freehold to a foreign national, either to a Thai or another foreigner, there can be formality issues associated with that transfer. What are we talking about here? Well for example there is a requirement that money on a foreign freehold titled condo, money brought in to purchase that condo come from abroad. There are also provisions when that condo is sold, that the money leave the country. So meeting the foreign capital requirements can be formalities in and of themselves. I anticipate more and more moving forward, tax also will likely become part of the process of transferring a condo and as a result could add some more bureaucratic formalities associated with the transfer itself. The thing to take away from this video also transfer tax; there is a transfer fee here in Thailand, it is basically a Government Tax just paid to the Government in exchange for being able to transfer the title from one person to the other. 

So again, these are all things that you have to keep in mind when looking to go ahead and buy or sell a condominium here in the Kingdom Thailand.
