"Big Joke" Says Police Will Appeal Ruling On Thai Traffic Tickets?

As the title of this video suggests, we are discussing Surachate "Big Joke" Hakparn yet again. He apparently has come up in the context of maybe a little bit more mundane story than we usually see him affiliated with, but I thought of making this video after reading a recent article from the Bangkok Post, bangkokpost.com, the article is titled:  Police will still ticket motorists despite ruling. This is a really interesting article from a procedural standpoint. Now I am a bit of a law nerd so okay maybe it is interesting to me; other people might not find it so fascinating but the procedure here is very interesting. Quoting directly: "Motorists will continue to be ticketed despite the Central Administrative Court (CAC) deciding police have issued traffic tickets unlawfully since July 2020. The CAC ruled on September 27th that a Royal Thai Police (RTP) announcement which went into effect on July 20, 2020 pertaining to traffic tickets was unlawful. Quoting further: "According to Deputy National Police Chief, Police General Surachate Hakparn, (that is Big Joke), the RTP will appeal against the ruling, reports said. Pending the outcome, Pol Gen Surachate said fine will need to be paid at the rate specified in the announcement and Traffic Police will carry on issuing tickets." 

So even though there has been a decision in this, they are going to keep doing what they are doing. It remains to be seen exactly how this plays out from an adjudicatory standpoint. Again, I urge those watching this video, go check out that article to get the context procedurally but basically, the Administrative Court said that the way in which these tickets are being implemented and the fines are being assessed is not constitutional. Now whether or not this will hold up in a further appeal remains to be seen but we will certainly keep you updated on this channel as the situation evolves.
