Amended Corporate Tax Documents and Thai Work Permits

As the title of this video suggests, we are discussing Thai Work Permits, specifically in the context of Thai Corporate Taxes and we are talking about Corporate Income Tax and Audits; all of that kind of thing. It is just an umbrella video. 

The reason I bring this up is in the past there was a much more cavalier attitude toward the documentation associated with Work Permit application and renewal as well as Business Visa application and renewal. That paradigm, in my opinion, is a thing of the past because Immigration Officers are now very strict in adjudicating the documentation, they need in support of an application for a work permit or a visa. The reason I bring this up is because in the past, if you had issues with Corporate documentation and by issues, I mean you took everything in, an application for Work Permit renewal, and there was something wrong with the Corporate Taxes. Oftentimes you could just go back and amend your Corporate Taxes, especially in an SME context, amend your corporate taxes, bring them back and refile the application. More and more that is being viewed as pretextual or pretensive by the Immigration and Labor Department Officers and as a result I have seen folks be turned away for a work permit renewal and told, "No, you have fallen out of status here." Especially in the context that you have to meet certain tax requirements if you make a certain amount of money and if it is clear that someone is in arrears on their taxes, it doesn't make the Labor Department too happy about issuing a new Work Permit and we have seen folks who have been required to leave Thailand, get a new Visa, come back into Thailand, get their Work Permit again and come back into status that way. It is just part and parcel of the more stringent enforcement paradigm they now have. As a result, I think we are going to see this more and more moving forward. 

This is one of the reasons it is very important to have competent a professional assisting, not just with the work permit itself. We will often see people contact us and want us to do their work permit and it is like, “You don't have any of the required documentation or everything is in disarray.” It is really a good idea to have somebody with you step-by-step as the months and years go by that files this correctly in order to maintain one's work authorization and legal status here in the Kingdom of Thailand.
