Thai Business Visas, Work Permits, and Corporate Wind Down?

As the title of this video suggests, we are discussing Thai Business Visas. Imputed with that is Thai Work Permits so maybe the title of this video should be Thai Business Visas, Work Permits and Corporate Wind Down, in fact that's probably what we will call this video. Let's title this video that: Thai Business Visas, Work Permits and Corporate Wind Down.
In any event, what are we talking about here? Well let's say you have a Thai company and you are looking to wind it down, you are looking to close it down but you are kind of transitioning, maybe you are retiring. This happens a lot in the context of retirees. How do you go ahead and do that because during the wind down process, you are probably going to engage in activity that constitutes employment in Thailand or work, which means you still need your Work Permit. It's a bit of a weird tightrope to walk. We have had to deal with this multiple times in a wind down situation. General recommendation is maintain Work Permit and Business Visa status until the corporation is completely wound down. Now again it is going to be circumstantially dependent, so those out there who are looking at this probably a really good idea, in fact it is a really good idea, contact a legal professional on this topic because there are a lot of ways that one could find themselves in unforeseen problems if they don't maintain their Business Visa and Work Permit correctly while they are dealing with a wind down.
Now for those who are unaware, it is possible to wind down a Thai Corporation. It can be a lot more cumbersome process compared to sort of similar processes you deal with in other jurisdictions. That said, it can be done relatively efficiently but the thing to understand is as a foreigner you have still got work authorization and lawful status issues you have got to deal with and for that reason it is probably best, again it is going to be circumstantially dependent, probably best to maintain that status for as long as possible. That said and I reiterate this again, the best thing to do at the beginning or the outset of even doing the analysis of how best to proceed is to go ahead and contact a legal professional.
