Thai Banking Issues Associated With Condo Transfer

As the title of this video suggests, we are discussing banking in the context of condo transfers. Now for those who are unaware, it is possible for a foreign national to own a condo here in the Kingdom of Thailand notwithstanding the restrictions on foreign ownership of Thai properties.

We have discussed in many other videos, real estate is restricted from foreign ownership; most notably land is restricted from foreign ownership here in Thailand, but it may be possible to gain what some call Freehold Title in the Commonwealth vernacular, what is called Chanote Title here in Thailand; the Chanote which literally is the Title Deed. So we have discussed in other videos there are red Chanotes, green Chanotes, black Chanotes, but red Chanotes which is Freehold Title, what we would also call Fee Simple Absolute in the more sort of Westminster Law or American Common Law jurisprudence, the notion of Fee Simple Absolute title which again Freehold Title; you own a title, you own that condo. 

Now there are banking issues associated with this as there are provisions of the Thai Condominium Act which stipulate that foreign funds must come in from abroad in order for a foreigner to purchase property, specifically condos, here in Thailand. For this reason, certain formalities associated with banking can be rather complex and in some cases a little bit Byzantine when you are trying to deal with a transfer of a Thai Condo. For this reason, it is really not a terrible idea to contact a legal professional associated with property conveyancing and gain some insight and guidance into how best to proceed.
