Lawyer or Attorney from the United States of America in Thailand

For many American Citizens living, working, traveling, or permanently residing in Thailand; a situation occasionally arises where an American attorney is necessary. In these situations, communicating with a lawyer half a world away is not feasible. In the majority of cases arising in the Kingdom of Thailand an American attorney is needed in order to interface with the United States Embassy in Bangkok, Thailand or the United States Consulate in Chiang Mai, Thailand. Also, a licensed attorney from the United States is entitled to represent clients before the United States Citizenship and Immigration Service (USCIS). At the time of this writing, the United States Citizenship and Immigration Service (USCIS) maintains an office across the street from the US Embassy in Bangkok.

Unfortunately, in Thailand there are many “fly by night” operations claiming expertise in United States Immigration law. These operations are often headed by foreign nationals claiming to be American attorneys. For those seeking the advice of a competent US attorney, be advised: Only a LICENSED attorney can represent clients before the United States Citizenship and Immigration Service (USCIS). Further, under current US Embassy policy, only an applicant or their licensed American attorney is entitled to correspond with the American Embassy regarding a pending visa application. Do not be fooled by those claiming legal credentials and if in doubt simply ask the person claiming to be an attorney if he or she has a license to practice law. If they answer in the affirmative ask to see the license or a copy of the license. If such a document cannot be produced, then it may be advisable to seek legal advice elsewhere.

An American attorney can also assist with legal issues arising in the United States. For example, if one has a pending arrest warrant in a jurisdiction of the United States of America, then an American attorney may be able to assist in dealing with the authorities and getting the situation resolved. Further, an American attorney can assist in the drafting of a prenuptial agreement or a will. Either of these documents should be drafted by one with extensive legal knowledge and experience dealing with the ramifications of different legal instruments. In situations where an American lawyer cannot handle the matter in Thailand, then, in all likelihood, the attorney in Thailand could refer the matter to another attorney in the United States.
